Thank you for placing an order with FOTC NZ Merch
Online Payment
All online purchases must be paid for prior to shipment of the products, no matter what the value. We retain title to the products you order until you have made payment in full for those products. We reserve the right to refuse to accept credit cards on the basis of country of origin, issuing bank or upon the requirements or recommendation of our payment processor.
Confirmation of Order
Your order with us is not confirmed until you have received a return email from FOTC NZ Merch advising we have received your order and payment and that your order is being processed
Shipping & Taxes
The cost of shipping is exclusive to the price of your items. Your order will be shipped by New Zealand Post Standard service. Although in most cases it will be much shorter please allow up to 10 days for delivery.
Shipping details must include your full address and daytime telephone number. Your order cannot be processed if these details are missing. New Zealand GST is included in the purchase price at the rate of 12.5 %.
Availability
Please note that quantities of products available for sale from this site are limited, so products may become sold out. If this should occur and the merchandise is not available on back-order, we will promptly refund any payment which we may have received from merchandise that is unavailable. We will email confirmation of the credit refund in this case.
Prices of products and other charges displayed on this website are current at the time of issue, but may change at any time and are subject to availability.
Ordering Goods
Orders can only be placed by people who can make legally binding contracts. Any order placed by you via this website is an offer to you to purchase a particular product for the price (including the delivery and other charges) specified on this website at the time you place your order.
We reserve the right to accept or reject your offer for any reason, including, without limitation, the unavailability of any product, an error in the price or the product description posted on this website, an error in your order or a failure in your payment.
Customer Information on Your Order
We are not responsible for any customer input errors or typographical errors in your name or address when you enter it in the order form. You are responsible for verifying all information is correct before submitting an order.
We will endeavour in all cases to have returned any shipment that is not delivered as a result of any error in your order form, but if this is not possible the responsibility and onus remains with you.
Limitation of Liability
FOTC NZ Merch will not be liable for any direct or indirect loss, damages, personal injury, accident, or special or consequential damages that result from the use of, or the inability to use, the products or the performance of the products.
Variation and Termination
These terms and conditions, or any part of them, may be varied or terminated by FOTC NZ Merch without notice at any time, for any reason. Any variation will be binding when published on this website.
Consumer Guarantees Act 1993
If the purchaser is acquiring goods for the purposes of a trade or business, the purchaser acknowledges that the provisions of the Consumer Guarantees Act 1993 do not apply to the supply of goods by FOTC NZ MERCH to the purchaser.
Returns
If your order has been damaged in transit, is of incorrect size, has a manufacturing defect, or if an incorrect item has been shipped to you please contact us within 48 hours on nzmerch@flightoftheconchords.co.nz
For orders with delivery addresses in New Zealand non-business purchasers are protected by the Consumer Guarantees Act (CGA).
Shipping and handling charges on any returned items are non refundable. When returning items we are not responsible for lost items so we recommend you courier them back to us.
Currency
All pricing is in New Zealand dollars.
Jurisdiction
FOTC NZ Merch is based in Wellington, New Zealand and operates under New Zealand business law. Any disputes will be held under New Zealand law and in a New Zealand court of law.
